These terms govern your use of Hummingbird ("the App"), provided by FlockLabs. By installing or using the App, you agree to these terms.
Use of the App
Hummingbird is provided for personal, non-commercial use to help you run structured indoor cycling workouts against your own Bluetooth smart trainer. You must be at least 16 years old to use the App.
Health & fitness disclaimer
Hummingbird is not a medical device and does not provide medical advice. Consult a physician before beginning any new exercise program, especially if you have an existing health condition. Power, heart rate, and other metrics shown in the App are estimates based on data reported by your trainer and are provided for informational purposes only.
Third-party hardware
The App is designed to work with third-party Bluetooth smart trainers implementing the Fitness Machine Service (FTMS) standard. We do not manufacture this hardware and are not responsible for its accuracy, safety, or reliability. Use trainer hardware according to its manufacturer's instructions.
Strava
Hummingbird integrates with Strava's API to let you optionally upload rides to your Strava account. This integration is provided under Strava's API Agreement. Hummingbird is not affiliated with, endorsed by, or sponsored by Strava, Inc. "Strava" is a trademark of Strava, Inc. Your use of Strava is governed by Strava's own terms of service.
No warranty
The App is provided "as is," without warranty of any kind, express or implied, including but not limited to accuracy of any workout metric, fitness for a particular purpose, or uninterrupted operation.
Limitation of liability
To the maximum extent permitted by law, FlockLabs shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including but not limited to injury sustained while exercising, hardware malfunction, or data loss.
Changes
We may update these terms from time to time; the date at the top of this page will reflect the latest revision. Continued use of the App after a change means you accept the update.
Governing law
These terms are governed by the laws of Switzerland, without regard to conflict-of-law principles.
